- Acceptance
By using spanofootwear.com or placing an order, you agree to these Terms. Nothing in these Terms excludes, restricts or modifies rights available under the Australian Consumer Law.
- Our Products
Spano Footwear supplies standard, comfort, orthopaedic, medical-related and custom-made footwear, orthotics, footwear modifications and related products and services. Some products are individually selected, fitted, measured, modified or manufactured.
- Orders
An order constitutes an offer to purchase. We may decline or cancel an order where a product is unavailable, there is an obvious pricing error, information is incomplete or inaccurate, fraud is suspected, or we cannot reasonably fulfil the order. Where payment has been received and we cancel an order, an appropriate refund will be provided subject to applicable law.
- Prices and Payment
All prices are in Australian dollars unless otherwise stated. Prices may change from time to time. A confirmed order will generally be supplied at the price accepted at the time of purchase, subject to obvious pricing errors. Online payments are processed through Shopify and applicable payment providers.
- Delivery
We will use reasonable efforts to dispatch orders within the timeframe communicated at purchase. Delivery times may vary due to product availability, custom manufacturing, supplier or courier delays, public holidays, weather or circumstances outside our reasonable control. Delivery estimates are not guaranteed delivery dates. Customers should inspect products as soon as reasonably practicable after receipt.
- Medical and Specialised Products
Some products are intended for customers with specific foot, mobility or orthopaedic requirements and may require individual assessment, measurements, fitting or modification. Website information is general and does not replace individual medical advice. Where a customer communicates a particular purpose and relies on our advice, that information will be considered in accordance with our obligations under the Australian Consumer Law.
- Product Care and Use
Customers should use products in accordance with supplied instructions and their intended purpose. Spano Footwear is not responsible, to the extent permitted by law, for damage caused by misuse, abnormal use, accidental damage, unauthorised alteration, failure to follow care instructions or use for an unintended purpose. This does not limit any rights under the Australian Consumer Law.
- Website Information
We endeavour to ensure product descriptions, images, measurements and prices are accurate. Minor differences may occur due to photography, screen settings or manufacturing variations. Nothing in this section excludes consumer rights.
- Intellectual Property
All content on spanofootwear.com, including logos, photographs, graphics, text and branding, is owned by or licensed to Spano Footwear. Content must not be reproduced or commercially exploited without permission except where permitted by law.
- Limitation of Liability
To the maximum extent permitted by law, Spano Footwear excludes liability for loss or damage arising from matters outside our reasonable control. Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot legally be excluded under Australian law.
- Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You may be entitled to a replacement or refund for a major failure and compensation for reasonably foreseeable loss or damage. Nothing in these Terms removes or limits those rights.
- Changes to These Terms
We may update these Terms from time to time. The current version will be published on spanofootwear.com. Changes generally apply to orders placed after the updated Terms are published.
- Governing Law
These Terms are governed by the laws of South Australia and Australia. Any dispute will be dealt with in accordance with applicable Australian law.
